SELECTED CASE LAW
BRITISH COLUMBIA:
2017 BCPC 233 was a pretrial hearing. Mr. W was accused of uttering threats, assault with a weapon, and harassment. Mr. W’s girlfriend, Ms. B, allegedly overheard Mr. W speaking on the phone with someone where he threatened to cut off Ms. B’s head with a chainsaw. However, the dates on the indictment alleging harassment were not consistent with the date on which Ms. B began fearing for her safety and therefore Mr. W could not be convicted on the harassment charge and it was dropped.
